Bang Ordered to ‘Cease’ Activity in PepsiCo Distribution Territory

An emergency arbitrator has ordered Bang Energy for now to stop actions to take distribution back from PepsiCo. The interim ruling filed today also orders Bang owner Vita Pharmaceuticals to abide by the terms of its distribution agreement with PepsiCo during the contract’s three-year notice period...The full court document is available for Beverage Digest subscribers HERE.

Following Bang Energy’s termination of its 10-year distribution deal with PepsiCo and subsequent lawsuit, BD requested interviews with Bang Founder and CEO John H. “Jack” Owoc and other company officials. Owoc, on behalf of Bang Energy, agreed to answer written questions by email.

Earlier this month, PepsiCo CEO Ramon Laguarta announced a set of initiatives and related spending aimed at Hispanic businesses, consumers, communities and employees. Some of that work will pass through the relatively new Hispanic Business Unit of PepsiCo Beverages North America (PBNA), which is now in its third year. In 2020, the company added a similar unit for PepsiCo Foods North America. BD reached out to Esperanza Teasdale, the VP and GM who leads the Hispanic Business Unit for beverages, reporting to PBNA CMO Greg Lyons. Teasdale discussed her team’s work to capture a greater share of the $2.6 trillion in annual spending in the US by Hispanic consumers. Late last month, Coca-Cola went all in on the fast-growing US hard seltzer category, signing up Molson Coors Beverage to manufacture, market, and distribute Coke’s new Topo Chico hard Seltzer.
